B: What is it, Mrs. Wang?

W: It's about the quality of 300 cartons of dried mushrooms. They reached us two weeks ago, and were immediately examined after they arrived. To our astonishment, about 20% of them were moldy and in many cartons there were even small brownish bugs crawling in and out of the half- eaten mushrooms. We can't accept them in this state. They are unfit for human consumption. And the Medical Officer of Health has issued a ?Stop Notice?on them.

B: Is that so? So far we haven't had any complaint of this kind. Our mush- rooms have enjoyed a good reputation for their superior quality for years. We are really at a loss to understand why your lot was found moldy and worm-eaten. Have you any evidence?

W: Certainly. Here's a survey report by a well-known lab in London, whose testimony is absolutely reliable.

So it is obvious the cause of the damage is that the mushrooms were not completely dried before packing.

B: As you know, before shipment, the Commodity InspectionBureau inspected the goods in question. They concluded that the goods were well dehydrated from fresh and choice material and up to standard for export.

W: I think the Inspection Bureau at your end, when effecting inspection, only selected a few package at random -- these hap- pened to be up to the standard. The part that was not dried properly, most probably, escaped their attention. As the amount in question is only 20% of the whole shipment, I think it is only reasonable that you should compensate us for the loss.

Your claim, in our opinion, should be re- ferred to the insurance company, as the mishap occurred after shipment.

W: We've already got in touch with the underwriter. But they have refused to accept any liability. They attributed the accident to the effects of dampness during the long sea voyage.

B: That's a matter over which we could exercise no control, then. I'm afraid I have to insist that you approach the insurance company for settlement, that is, if you have covered this risk in your coverage.

W: To my regret, we failed to cover contamination. This is an unfortu- nate oversight on our part and a lesson to us.

B: Otherwise the insurance company would no doubt have enter- tained your case.

W: Well, live and learn. It seems we'll have to waive the claim.

如何应付面试?

应试者大谈个人成就、特长、技能时,聪明的面试官一旦反问:“能举一两个例子吗”?应试者便无言应对,而面试官恰恰认为:事实胜于雄辩。在面试中,应试者要想以其所谓的沟通能力、解决问题的能力、团队合作能力,领导能力等取信于人,唯有举例。

五、缺乏积极态势

what you do: involve her in the process by asking, “given such a tight deadline, what would you do to make this a success?” soliciting her guidance makes it more difficult for her to blame you later if things go badly.

she says: “where have you been all afternoon?”

she means: i'm a little needy right now and want you by my side 24/7.

what you do: sell her on the upside of your absence: “i took our clients to lunch, and i think i convinced them to renew their contract with us!” next time, be sure to remind her the day before, the morning of, and an hour prior to heading out of the office, and leave a note explicitly saying when you'll be back.

she says: nothing―she hasn't responded to any of your e-mails in days.

she means: i'm incredibly busy. don't e-mail me unless it's urgent.

what you do: first, stop pinging her about minor matters. then, be direct with her about the best way to communicate. taylor suggests something like, “i know you're inundated. would it be easier for you if i asked your assistant to set up a meeting for us to review my questions and ideas?”

she says: “you haven't finished the report yet?!”

she means: i may be blowing this out of proportion, but i'm overwhelmed and, yes, i'm taking it out on you.

what you do: the simple truth is that your boss needs to vent periodically―and you're the unlucky sap standing in front of her when she blows. just be professional―no trembling lower lip, ladies! she'll probably pop by later to smooth things over. accept her peace offering and move on.

房地产损害的分类

(1)按照房地产受损害的部位划分

按照房地产受损害的部位可划分为三种类型:

①实物损害(又可分为实体损害和功能损害);

②权益损害;

③区位损害(也称为环境损害)。

(2)按照房地产可修复的损害和不可修复的损害划分

房地产可修复的损害是指恢复到损害前的状况或者好于损害前的状况,有的是修理,有的是更换。即:修复费用≤损害前的房地产价值-损害后的房地产价值。

房地产不可修复的损害是指技术上不可能或经济上不可行,因而不能修复的损害。即:修复费用>损害前的房地产价值-损害后的房地产价值。

(3)按照暂时性的损害和永久性的损害划分。

二、房屋所有权的类型

对房屋所有权加以分类,明确不同类别所有权的性质和特征,便于房屋所有权的行使和对房屋的管理。房屋所有权可从不同角度加以分类:

1、从所有权权利主体的内部构成来看,可分为房屋单独所有、房屋共有和房屋的'区分所有。房屋的单独所有是指在某一房屋上只有一个所有权主体。

2、从房屋所有权权利主体所享有的权能是否充分来分,可将房屋所有权分为完全的房屋所有权和房屋部分所有权。完全的房屋所有权就是我们通常所说的房屋所有权;房屋部分所有权是一种受到限制的房屋所有权,后文将对之作专门介绍。

3、我国的房产登记,按照房产性质将房屋所有权分为以下几类:

(1)公有房产,即国家房屋所有权和集体房屋所有权以及建筑物区分所有权。其客体包括房地产管理部门直管的国有房屋,国家机关、全民所有制单位、军队使用的国有房屋和其他国家所有的房屋,以及集体所有制企业、单位拥有所有权的房屋。

(2)私有房产,即公民个人房屋所有权。其客体是我国公民,包括华侨、侨眷、归侨、港澳台同胞拥有的私人房屋。

(3)中外合资房产,即中外合资房屋所有权。其客体是我国政府、企业与外国政府、企业或个人共同投资拥有的房屋。

(4)外资房产,即外资房屋所有权。其客体是外国政府、企业、社会团体、国际性机构及外国人、无国籍人在我国境内所拥有的房屋。

(5)其他房产。其客体是不可归于以上种类房产的房屋,如宗教组织拥有的房屋。

三、装修工程质量问题纠纷怎么处理?

(一)通过仲裁解决

双方对问题都无法解决的情况下,那么最佳的方法就是通过技术部门来进行鉴定。不管是那一方都好,如果认为自己没有错,那么最佳的办法就是找质检部门来做一个技术鉴定。从而做为仲裁。但技术部门往往只能起鉴定的作用,并不能有效解决争端。

(二)通过法院裁决解决

双方最终都不欢而散的情况下,那只有通过法院来解决问题。这是一种最无奈的解决方法,因为双方都得浪费时间浪费金钱。而且绝大部分的结果都是决裂的。所以,这一招是不得已而为之的事情,当然,我们得承认这是最有决定效力的行为,因为任何人都得遵守法院的裁决。

有的房主要求装修公司返工或维修;有的房主已对原装修公司失去信心,不想再让它返工或维修,只要求它赔偿损失。这两种方式都是可行的,也都符合法律的规定。

首先看双方是否在装修合同中约定了违约责任。

《民法通则》第112条第2款规定:“当事人可以在合同中约定,一方违反合同时,向另一方支付一定数额的违约金;也可以在合同中约定对于违反合同而产生的损失赔偿额的计算方法。”《合同法》第114条第1款也有相同的规定。据此,签订装修合同时,可以约定如果某个施工项目所用材料不合格,则此项施工的费用,包括材料费和工费应从总价款中扣除,已付款的,应由装修公司退回。也可以约定如果某个施工项目因施工不规范造成部分工程不合格,如部分墙砖脱落或部分墙面起泡等,则应按不合格部分占此项目的比例,扣除此项目的价款。如果合同中有相关的约定,则可以根据这些条款确定损失赔偿额。

如果双方在装修合同中没有约定违约金或损失赔偿额的计算方法,那么根据《民法通则》第112条第1款:“当事人一方违反合同的赔偿责任,应当相当于另一方因此所受到的损失。”的规定和《合同法》第113条:“当事人一方不履行合同义务或者履行合同义务不符合约定,给对方造成损失的,损失赔偿额应当相当于因违约所造成的损失。”的规定,房主可以要求装修公司按实际损失赔偿。当然实际损失如何确定,双方可能仍会有分歧。如果协商不成,可以委托评估机构进行评估,然后由装修公司按评估的价值与合同约定价款的差值进行赔偿。

(三)通过消费者交涉投诉解决

1、必须在行业协会派员或监理人员协助下以事实为根据与施工方或材料供应商进行协商解决。确为价格偏差者则应合理退赔,如属工程质量问题,施工方应无条件返修。如为材质问题,材料供应商应按有关规定给换货或经济赔偿。

2、委托方的投诉要做好取证工作。何谓取证,即握有交涉投诉的证据、合同文本、有关材质的物证、维持工程施工的现场等。
